PRESS RELEASE5 November 1998Temple Terrace, Florida CONTACT: Abraham J. Bonowitz: 800-973-6548 or NOT ALL FLORIDIANS WERE DECEIVED Activists focused in Temple Terrace area to show where voters knew the truth they defeated Amendment #2 Amendment #2 to be challenged in court. Voters in Hillsborough County's Temple Terrace Precinct #655 were practically the only voters in the county, and possibly in all of Florida to defeat Amendment #2. The "Vote No On Amendment #2" Campaign engaged in an intense, highly focused effort to educate voters about the deceptive Amendment #2 by erecting hundreds of yard signs and canvassing the homes of registered voters in the highly conserative Temple Terrace precinct #655. "In contrast the rest of the County, and quite possibly the rest of the state, 54% of the voters rejected Amendment #2 despite its deceptive ballot title," said Abe Bonowitz, Political Director for the campaign. "Legislators very shrewdly and deceptively turned this constitutional amendment into a referendum on the death penalty itself. We wanted to show that where the voters had the chance to really understand Amendment #2, they would reject it. By doing this in the home town and district of the Amendment's author, we are putting legislators on notice: ‘When your voters know the truth, they will demand better public policy.'" The State of Florida approved Amendment #2 by a margin of 66% voting yes and 34% voting no. Hillsborough County voted similarly. Within Hillsborough County, almost every precinct voted yes to Amendment #2, with the notable exception of precinct #655 which defeated the Amendment with 803 "no" votes to 685 "yes" votes. "There was so much confusion about this Amendment, even the League of Women Voters put out an assessment which was factually inaccurate," said Bonowitz. "We have shown that Amendment #2 would have been defeated if only the voters knew the truth. Now Amendment #2 will have to be reversed in the courts." The lawsuit filed by religious leaders seeking removal of the amendment from the ballot will be continued. The Florida Supreme Court had originally declined to hear the Petition in a vote of 4 to 3. It is unclear if the high court will hear arguments before election day on Nov. 3rd. "It is encouraging that the First District Court of Appeals has certified the challenge to Amendment 2 back to the Supreme Court," stated Randy Berg, attorney for the petitioners and Executive Director of the Florida Justice Institute in Miami. "The District Court noted that this matter is of great public importance. We believe the Court should at least listen to argument as to why the ballot title and summary are clearly misleading to the public." "We have been canvassing for over a week now, and we are finding that voters are very confused about all of the amendments, but in particular about Amendment #2," said Abraham Bonowitz, Political Director of the Vote No On Amendment #2 Campaign. "Not only is the ballot language misleading, this amendment is so hard to understand that even the League of Women Voters has published an analysis which is factually inaccurate. At least we know that if the Florida Supreme Court declines to hear the matter now, there is still an opportunity for the Court to hear it after the election, assuming the amendment passes. Of course, it would be far preferable for the Court to deal with it sooner rather than later." The "Vote No On Amendment #2" Campaign is engaged in an intense, highly focused effort to educate Florida voters about the deceptive Amendment #2, which will appear on the November ballot unless a lawsuit to remove it is successful. For almost two weeks, "Vote No On #2" Campaign volunteers have erected hundreds of yard signs and canvassed the homes of registered voters in Temple Terrace precincts of Florida House of Representatives District 60. Volunteers across the state are waging similar, low key public education campaigns within their own communities. "We chose District 60 because of the demographics and local support," said Abraham Bonowitz, Political Director for the campaign. "We did not want to challenge any one politician, and because there is no contest for the District 60 seat, our efforts to educate voters should be seen as non-partisan. Our message is for the entire legislature." The goal of the statewide campaign is to provide free information to Florida voters via the campaign's toll free phone number and web page. The goal of the intense local effort is to demonstrate to Florida legislators that when the voters know the truth about deceptive constitutional amendments like Amendment #2, they will oppose them. "We believe that most Florida voters are very much like those here in Temple Terrace," said Bonowitz. Smart people who want sound public policy, and no one has given them straight, factual information. Informed voters will vote NO on Amendment #2."
