Complaining that judges are dragging their heels in a matter of life and death, a citizens group has announced a protest demonstration for next Tuesday, May 31st, from 9:30 AM to 6 PM at the federal courthouse, 100 East Fifth St., in Cincinnati.

Citizens United for Rehabilitation of Errants (CURE) will picket the United States Court of Appeals for the Sixth Circuit to protest the lack of action from the Court on a complaint of judicial misconduct. The Sixth Circuit has jurisdiction over the four states of Ohio, Kentucky, Tennessee and Michigan.

"Claudia Whitman, our death penalty expert, and I filed this complaint 15 months ago," Charles Sullivan, CURE's Director said, "and their rules are that is should be processed in a month."

The complaint states that Lewis Williams was illegally executed by the State of Ohio through an illegal act on the part of the 6th Circuit Court of Appeals. Chief Judge Danny Boggs violated the law by allowing Senior Judges Richard Suhrheinrich and Cornelia Kennedy to vote to deny Williams a hearing.

Federal law allows senior judges to participate in a vote by the full court only if the judges participated in the initial panel ruling on the same case. Without these two votes, the request for a hearing would have been granted. Five of the Sixth Circuit Judges filed a dissenting opinion stating that Williams was executed illegally.

CURE's complaint is No. 04-6-351-14 and the phone number of the Office of the Sixth Circuit Executive is 513-564-7200. CURE is a national grassroots prison reform organization with chapters in most states.
